PLEASE READ THESE TERMS AND CONDITIONS OF SALE CAREFULLY BEFORE MAKING YOUR DECISION TO PURCHASE.

1.1 Flourish Horse Health Ltd and associated web addresses are intended only for customers wishing to order company products. The terms and conditions under which the Products are offered for sale on the website www.flourishhorsehealth.com are set out below. By placing an order on the Website, you accept and agree to be bound by these terms and conditions.

Flourish Horse Health Ltd reserves the right to change these terms and conditions at any time without prior notice. Such change however will have no effect on orders that were submitted before posting of such revised terms and conditions on this Website.

PLACING YOUR ORDER

2.1 To place an order, you must be at least 16 years of age or have permission from an adult who is accessible by telephone and has a valid email address.

2.2 You may place orders via our website shop or direct via e-mail orders@flourishhorsehealth.com

2.3 When you place your order, you will receive an order confirmation from the payment provider.

2.4 As orders are made fresh to order, once we have confirmed your order it cannot be cancelled.

2.5 Please note that the on-screen display of the colours of merchandise and brochures etc may differ from the actual appearance of Products offered on the Website.

SUPPLY OF YOUR PRODUCTS

Subject to these terms and conditions, Flourish Horse Health Ltd will supply to you the Products indicated on your order confirmation.

PRICES

3.1 All prices are in GBP. Prices shall be those prices published on this website at the time you submit your order. Transport costs and VAT may be calculated separately as applicable and specified on the order form and total price of the order. The total price stated on the order form you submit shall be the total amount payable by you for the products including shipping.

3.2 If a product is under-priced by mistake, we will not be liable to supply that product to you at the stated price, if we notify you before we dispatch the product to you. In those circumstances, we reserve the right to cancel your order. In the event we cancel your order, we will give you a full refund on any amount already paid for that product in accordance with our return and refund policy.

3.3 Delivery costs are payable by you as indicated on your order confirmation.

PAYING FOR YOUR PRODUCTS

4.1 You may pay for your Products by the methods of payment as may be displayed at the website checkout.

4.2 You must pay in the currency as indicated on your invoice.

4.3 If you are paying by credit or debit card, then you must supply your credit or debit card details when you place your order. Flourish Horse Health Ltd will not supply the Products to you, nor perform the services until your credit or debit card issuer has authorised the use of your card for payment of the Products and/or services ordered. If flourishhorsehealth.com does not receive such authorisation we shall inform you accordingly. Flourish Horse Health Ltd reserves the right to verify the identity of the credit or debit card holder by requesting appropriate documentation.

DELIVERY OF YOUR PRODUCTS

5.1 Flourish Horse Health Ltd will deliver the Products to the delivery address you have specified in the order form and in accordance with the delivery option you have chosen. If you order various Products to be delivered to different addresses, you will need to submit a separate order form for each delivery address. Any delivery dates given by flourishhorsehealth.com are best estimates only and Flourish Horse Health Ltd shall not be liable for any loss, damage, costs or expenses for failure to deliver in accordance with the delivery dates given. In the event that any of the Products ordered are out of stock the whole order may be delayed. If so, an estimate of the delay will be given by e-mail.

5.2 Title to and risk of loss for your Products will pass to you on delivery of the Products.

EXCHANGES, RETURNS AND REFUNDS

6.1. UK Orders may be cancelled before despatch or returned to Flourish Horse Health Ltd up to 7 days post-despatch  providing the product has not been damaged, opened or consumed, and is in the same condition as it was when despatched to the customer. The customer will be liable for the cost of the product being returned, then after assessment of the product a refund will be issued for the product and the outbound shipping costs.

6.2 Orders sent outside of the UK may be cancelled up to the point of manufacture and/or attachment of own country labels. If transport is ordered by the non-UK purchaser, Flourish Horse Health Ltd will not be liable for delays outside of our control but will inform the non-UK buyer as soon as possible. Any costs incurred for transport delays are the responsibility of the purchaser. Costs for any returns are the responsibility of the purchaser and the goods must arrive in the same condition as despatch.

6.3 If a Product was supplied in error, is incomplete or faulty and you believe that you are entitled to a replacement in accordance with paragraph 8 below, please contact us at orders@flourishhorsehealth.com with proof or evidence within 24 hours of receipt of the goods. Please send images of damaged goods and sign off the transport paperwork marking damage to order.

6.4. Steps to follow to claim a refund:

Cancellation can be exercised in writing or any other durable medium by emailing us at orders@flourishhorsehealth.com
before returning any Product(s) it is helpful if you check that you have:
Used appropriate packaging.
Clearly displayed the returns address.
Sealed the packaging securely.
Following these steps will help ensure the Product(s) arrive at the correct destination and in good condition within a timely fashion.

DAMAGES/CLAIMS

7.1 If a Product was supplied in error, is incomplete or faulty and you believe that you are entitled to a replacement or repair, please contact us at with proof or evidence. Please send images of damaged goods and sign off the transport paperwork marking damage to order. Once the claim is processed and agreed, we will replace bags damaged in transit on next order.

FLOURISH HORSE HEALTH LTD LIABILITIES

8.1 These terms and conditions set out the full extent of our obligations and liabilities in respect of the supply of the Products and the performance of any Services.

8.2 Flourish Horse Health Ltd will not be liable under the contract for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by Tort (including negligence), Breach of Contract or otherwise.

8.3 This does not affect your statutory rights as a consumer.

DATA PROTECTION

9.1 By placing your order, you agreed and understand that Flourish Horse Health Ltd may store, process, and use the data collected from your order form for processing your order. This data will be treated in compliance with the Flourish Horse Health Ltd Privacy Policy. If you wish to have access to information, we hold concerning you, or if you want to make any changes, or if you do not want to receive information from Flourish Horse Health Ltd please follow the update procedure set out in the Privacy Policy.

CIRCUMSTANCES BEYOND REASONABLE CONTROL

Flourish Horse Health Ltd will make every effort to perform its obligations under the contract. However, it cannot be held responsible for delays or failure to perform if such delay or failure is caused by any circumstances beyond our reasonable control. In the event of a delay, we will perform our obligations as soon as reasonably possible.

DISAGREEMENTS GOVERNING LAW AND JURISDICTION

Flourish Horse Health Ltd will try to solve any disagreements quickly and efficiently. If you are not happy with the way it deals with any disagreement and you want to take court proceedings, you must do so within the courts of England & Wales.

DISCLAIMER: Due to the nature of our products being mostly plant derived ingredients with seasonal and naturally occurring variations in size, shape, structure and morphology, we cannot accept responsibility or accept returns for aesthetic or visual changes in our products.
